Allgemeine Geschäftsbedingungen Ursula Köster Relocation Service

I. Leistungsgegenstand

Ursula Köster Relocation Service ist ein Dienstleistungsunternehmen, das den Umzug von Mitarbeitern internationaler Unternehmen professionell organisiert und betreut.

II. Leistungsumfang

Der Umfang der Leistung bestimmt sich nach dem jeweiligen Auftrag in Verbindung mit der jeweils gültigen Leistungsbeschreibung, die dem Kunden bei Vertragsabschluss überreicht wird.

Ausdrücklich hingewiesen wird auf folgende Besonderheiten bei den einzelnen Leistungsmodulen:

– 1. Wohnungssuche & Wohnungsübergabe
Die Objektsuche erfolgt aufgrund des erstellten Anforderungsprofils. Die im Pauschalhonorar beinhalteten Besichtigungen sind auf 22 Stunden (inklusive Hin- und Rückfahrt) begrenzt. Kommt ein Mietvertrag anderweitig zustande, befreit dies den Auftraggeber nicht von seiner Zahlungsverpflichtung.

– 2. Registrierung EU und andere Nationalität
– Registrierung von Haustieren
Der Auftraggeber ist verpflichtet, die zur Durchführung des Auftrages nötigen persönlichen und sachlichen Voraussetzungen nachzuweisen und die hierfür gegebenenfalls erforderlichen Unterlagen rechtzeitig zur Verfügung zu stellen. Werden diese Mitwirkungspflichten vom Auftraggeber nicht erfüllt und kann deshalb der Auftrag nicht durchgeführt werden bleibt der Vergütungsanspruch des Unternehmens Ursula Köster Relocation Service bestehen.

– 3. Schul- bzw. Kindergartensuche
Inhalt des Auftrages ist die Darstellung der Schul- und Kindergartensituation am jeweiligen Standort, sowie die Beschreibung der vorhandenen Einrichtungen. Über die Aufnahme entscheidet allein der jeweilige Träger und das Unternehmen Ursula Köster Relocation Service übernimmt dafür keine Gewähr.

– 4. Führerschein
Das Unternehmen Ursula Köster Relocation Service haftet nicht für die Erfüllung der persönlichen Voraussetzung zur Erteilung des Führerscheins, bzw. der Umschreibung. Der Vergütungsanspruch des Unternehmens Ursula Köster Relocation Service entsteht mit der Einleitung der erforderlichen Formalien, unabhängig von der tatsächlichen Führerscheinaushändigung.

– 5. Wohnungsrückgabe
Das Unternehmen Ursula Köster Relocation Service tritt insoweit nicht in die Rechte und Verpflichtungen des Mieters aus dem Mietvertrag ein. Der Mieter haftet allein für die vertragsgemäße Rückgabe der Mietwohnung. Der Umfang der Vertretungsmacht bestimmt sich nach der jeweiligen Vollmacht.

Gegenstand des Vertrages ist in keinem Fall die Beratung des Auftraggebers in Rechts-, Steuer-, Versicherungs- und Ausländerfragen. Hierzu ist das Unternehmen Ursula Köster Relocation Service nicht berechtigt und nicht verpflichtet.

III. Leistungsvergütung

Die bei Auftragserteilung vereinbarte Vergütung ist zu je 50 % bei Beginn, bzw. Beendigung des Auftrages sofort fällig. Bei Leistungen, die über den vereinbarten Leistungsumfang hinausgehen, wird ein Stundenhonorar in Höhe von € 87,– netto pro Stunde in Rechnung gestellt.

Der Vergütungsanspruch des Unternehmens Ursula Köster Relocation Service entfällt nicht dadurch, dass der Auftraggeber Zahlungen wie z. B. Provisionen an Dritte zu leisten hat, die den selben Leistungsgegenstand betreffen.

Der Vertrag ist für beide Seiten nur kündbar aus wichtigem Grund. Erfolgt die Kündigung des Vertrages durch den Auftraggeber, ist das Unternehmen Ursula Köster Relocation Service gem. § 628 I Satz 1 BGB berechtigt, einen seinen bisherigen Leistungen entsprechenden Teil der Vergütung zu verlangen.

IV. Haftung

Die Haftung des Unternehmens Ursula Köster Relocation Service und seiner Erfüllungsgehilfen ist auf Vorsatz und grobe Fahrlässigkeit beschränkt. Ohne konkreten Nachweis eines höheren Schaden ist der Schadenersatzanspruch dabei beschränkt auf die Auftragssumme.

V. Datenschutz

Persönliche Daten des Auftraggebers bzw. des Relocatees werden ohne vorheriges Einverständnis des Betroffenen nicht an Dritte weitergegeben.

VI. Gerichtsstand

Als Gerichtsstand für etwaige Streitigkeiten wird Wolfratshausen vereinbart.
